What To Do in a Traffic Stop
In 2023, the Raleigh Police Department reported 39,088 traffic stops to the NC Bureau of Investigation – 12,303 of which resulted in citations. So what do you do when you find yourself pulled over for speeding or an expired document? Remember these simple tips to protect yourself & your rights!
DO Remain Calm. Getting pulled over can be stressful and confusing, but visible panic may be misinterpreted as guilt, or make it more difficult for you to think through your next steps.
DO NOT Admit Guilt. Police frequently ask “do you know why I stopped you?” However, you have a right to refuse to answer police questions, or to speak to your attorney before answering. Less is more; what you say can and will be used against you in the court of law!
DO Record. You have a first amendment right to record police interactions, as long as it doesn’t interfere with police business. You may also ask that the officer activate their body cam, but they may not have one or be required to turn it on.
DO NOT Remove Your Seatbelt. If you can’t prove you were buckled up before you stopped the car, you may be cited for violating seat belt laws.
ALWAYS Be Polite. Law Enforcement personnel are people too. It never hurts to be polite. Remember to address the agent by his/her title, or “sir/ma’am” and follow instructions slowly and calmly, asking for clarification if needed.
